Program:  Pennsylvania’s New Clean Slate Law:  Strategies to overcome Barriers Created by Criminal Records and Ethical Considerations

Pennsylvania was a leader in the nation in 2018 by providing automatic sealing and expungement for millions with criminal records, which created barriers to many to employment, housing, and other opportunities.  On December 13, 2023, Clean Slate 3.0 (originally HB 56) went into effect in Pennsylvania, expanding the categories of less serious drug felonies eligible for automatic sealing after ten years without a subsequent misdemeanor or felony; and sealing of property-related felonies with court approval of a petition.  Petitions for sealing can be filed for those eligible as of February 12, 2024, and automatic sealing will begin within the next four months.  A panel will discuss the new and existing clean slate law, ethical considerations for those with criminal records seeking employment, and opportunities for expansion of those understanding and obtaining a clean slate through pro bono practice, clinics and legal practice.
